By accessing or using CardGrade, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, you may not use our services.

We may modify these terms at any time. Continued use of CardGrade after changes constitutes acceptance of the modified terms. We will notify users of material changes via email or in-app notification.

You must be at least 18 years old to use CardGrade. By using our services, you represent that you meet this age requirement.

To use certain features of CardGrade, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate.

You are responsible for safeguarding your account credentials and for all activities that occur under your account. Notify us immediately of any unauthorized access or use of your account.

We reserve the right to suspend or terminate accounts that violate these terms or engage in fraudulent, abusive, or illegal activity.

CardGrade provides AI-powered trading card analysis through CGI Vision AI. Our services include grade predictions, condition analysis, and related features as described on our website.

Credits are required to perform card analyses. All credits — whether included with a subscription plan or purchased as credit packs — are non-refundable once issued or purchased. Subscription credits reset at each billing cycle and do not roll over to the next period. Credit pack purchases never expire but are non-refundable.

Promotional or bonus credits (including retention bonuses) are provided at CardGrade's sole discretion, are non-refundable, and may be subject to additional terms. Bonus credits are added as pack credits and do not expire.

We strive for accuracy but cannot guarantee that our predictions will match actual grades from professional grading companies. Our predictions are estimates based on image analysis and should not be relied upon as definitive.

You retain ownership of all card images and data you upload to CardGrade. By uploading content, you grant us a non-exclusive, worldwide license to use, process, and store your content to provide our services.

You represent that you have the right to upload content and that your content does not infringe on the rights of others or violate any laws.

We may use anonymized and aggregated data from user analyses to improve our AI models. You can opt out of AI training in your account settings.

You may not use CardGrade for any illegal purpose or in violation of any local, state, national, or international law.

You may not attempt to gain unauthorized access to our systems, interfere with our services, or circumvent any security measures.

You may not use automated systems (bots, scrapers, etc.) to access CardGrade without our express written permission.

You may not upload content that is malicious, harmful, or violates the rights of others.

Paid plans are billed in advance on a monthly or annual basis. You authorize us to charge your payment method for all fees incurred. By subscribing to a paid plan, you acknowledge that you are purchasing access to a digital service and agree that all charges are final and non-refundable.

Prices are subject to change. We will provide notice of price changes and such changes will take effect at the start of your next billing cycle.

You may upgrade your subscription plan at any time during a billing cycle. When you upgrade, you will be charged a prorated amount for the remainder of the current billing period reflecting the difference between your current plan and the new plan. This prorated charge is calculated automatically and is non-refundable.

Upon upgrading, your subscription credits will be immediately refreshed to the new plan's monthly allowance. Previous unused credits from the lower-tier plan are forfeited and are not refundable or convertible. Your billing cycle date and interval (monthly or annual) remain unchanged.

Upgrades are processed immediately and cannot be reversed. If you upgrade and later wish to return to a lower plan, you must follow the downgrade process described below. No refunds or credits will be issued for the difference.

You may cancel your subscription or request a downgrade at any time. Cancellation and downgrades take effect at the end of your current billing period — you will retain access to your current plan's features until the period expires. No refunds, prorated or otherwise, are provided for cancellations or downgrades, regardless of how much time remains in the billing period.

This applies equally to monthly and annual subscriptions. If you cancel an annual subscription on day one, you will retain access for the remainder of the annual period, but no refund will be issued for the unused months. By subscribing to an annual plan, you accept responsibility for the full annual commitment.

When you downgrade or cancel, any remaining unused subscription credits may be converted to pack credits at CardGrade's discretion. Converted pack credits do not expire but are non-refundable.

CardGrade may, at its sole discretion, offer retention incentives (such as bonus credits) to users who initiate a downgrade. Acceptance of a retention offer constitutes agreement to remain on your current plan. Retention bonuses are limited to one per billing period, are non-refundable, and cannot be exchanged for cash or applied as payment toward future billing.

ALL PURCHASES ON CARDGRADE ARE FINAL AND NON-REFUNDABLE. This includes, without limitation: monthly subscription fees, annual subscription fees, credit pack purchases, prorated upgrade charges, and any other fees charged through the platform.

No refunds will be issued for: unused credits (subscription or pack), unused time remaining on a subscription, dissatisfaction with AI grading predictions, account suspension or termination due to violations of these terms, failure to cancel a subscription before renewal, or any other reason.

You acknowledge that CardGrade provides a digital service and that credits are consumed upon use. By making a purchase, you expressly waive any right to a refund or chargeback to the maximum extent permitted by applicable law.

If you believe you were charged in error, contact support@cardgrade.io within 7 days of the charge. We will review legitimate billing errors but are under no obligation to issue a refund.

Filing a chargeback or payment dispute without first contacting CardGrade support will result in immediate account suspension. If a chargeback is filed, we reserve the right to permanently suspend the account, revoke all remaining credits (subscription and pack), and pursue recovery of the disputed amount plus any associated fees. We strongly encourage users to contact support@cardgrade.io to resolve any billing concerns before initiating a dispute with their payment provider.

CardGrade, CGI Vision AI, and all related trademarks, logos, and service marks are our property. You may not use our marks without prior written permission.

Our services, including all software, algorithms, and content, are protected by copyright, patent, and other intellectual property laws.

Nothing in these terms grants you any right to our intellectual property except the limited license to use our services as described herein.

CardGrade is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that our services will be uninterrupted, error-free, or completely secure. We do not warrant the accuracy or completeness of any information provided through our services.

Grade predictions are estimates and should not be relied upon as definitive assessments. Actual grades from professional grading companies may differ from our predictions.

To the maximum extent permitted by law, CardGrade and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages.

Our total liability for any claims arising from your use of CardGrade shall not exceed the amount you paid us in the twelve months preceding the claim.

Some jurisdictions do not allow limitation of liability, so these limitations may not apply to you.

You agree to indemnify and hold harmless CardGrade and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of our services or violation of these terms.

These terms are governed by the laws of the State of California, without regard to its conflict of law provisions.

Any disputes arising from these terms or your use of CardGrade shall be resolved in the state or federal courts located in Los Angeles County, California.

If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

Our failure to enforce any right or provision of these terms will not be considered a waiver of those rights.

These terms constitute the entire agreement between you and CardGrade regarding your use of our services.
